DMCA Policy

Overview
Orthodoxy, Inc. ("Orthodoxy") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, Orthodoxy will respond expeditiously to claims of copyright infringement committed using the Service where those claims are properly submitted under this policy.
Orthodoxy has registered a Designated Agent with the United States Copyright Office as required by 17 U.S.C. § 512(c)(2) to receive notifications of claimed infringement.
Designated Agent
Designated Agent for Notice of Copyright Infringement
This Designated Agent is registered with the U.S. Copyright Office pursuant to 17 U.S.C. § 512(c)(2). Notices sent to addresses other than those listed above will not be treated as valid DMCA notices.
Submitting a Copyright Infringement Notice
If you believe that material available through the Service infringes your copyright, you may submit a written notice of claimed infringement ("DMCA Notice") to the Designated Agent identified above. To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include all of the following:
- 1.A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
- 2.Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of such works.
- 3.Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit Orthodoxy to locate the material (e.g., the URL of the specific page or resource).
- 4.Information reasonably sufficient to permit Orthodoxy to contact you, such as your name, address, telephone number, and email address.
- 5.A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 6.A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Misrepresentations are subject to liability. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
Orthodoxy's Response
Upon receipt of a valid DMCA Notice, Orthodoxy will:
- —Promptly remove or disable access to the material identified in the notice.
- —Notify the user who submitted the allegedly infringing material that the material has been removed or disabled.
- —Provide the user with a copy of the DMCA Notice (with the complainant's personal contact information redacted as appropriate).
- —Inform the user of their right to submit a counter-notification under 17 U.S.C. § 512(g).
Please note that Orthodoxy is a platform for legal citation governance. The Service is not designed for the hosting or public sharing of copyrighted creative works. Most content submitted to the Service constitutes attorney work product or legal research content. Valid DMCA notices concerning such content should be directed to the law firm that controls the relevant matter, not to Orthodoxy.
Submitting a Counter-Notification
If you believe that material you submitted was removed or disabled as a result of mistake or misidentification of the material, you may submit a counter-notification ("Counter-Notice") to the Designated Agent. A valid Counter-Notice under 17 U.S.C. § 512(g)(3) must include:
- 1.Your physical or electronic signature.
- 2.Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- 3.A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- 4.Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Orthodoxy may be found, and that you will accept service of process from the person who provided the original DMCA Notice.
Upon receipt of a valid Counter-Notice, Orthodoxy will forward a copy to the original complainant and will restore the removed material or cease disabling access to it within ten (10) to fourteen (14) business days, unless the Designated Agent first receives notice from the original complainant that they have filed an action seeking a court order to restrain the allegedly infringing activity.
Repeat Infringer Policy
Orthodoxy will, in appropriate circumstances and at its sole discretion, terminate the accounts of users who are determined to be repeat infringers. Orthodoxy considers a user a repeat infringer if Orthodoxy has received more than one valid DMCA Notice regarding that user's submissions, and the user has not provided a valid Counter-Notice that was not subsequently challenged by the original complainant. Termination for repeat infringement is without prejudice to Orthodoxy's rights under the Terms of Service and Acceptable Use Policy.
